Upon the overturn of Roe, Idaho’s trigger bill was challenged in State court and upheld. It is now in effect as I.C. § 18-622. It makes abortion illegal for abortionists except in the cases of rape and incest. It leaves self-managed abortion legal by establishing:
“Nothing in this section shall be construed to subject a pregnant woman on whom any abortion is performed or attempted to any criminal conviction and penalty.”
Idaho State Rep. Heather Scott has introduced an abolition bill in the Idaho State House every year from 2018 to 2022. The primary opposition to her bill has been Rep. Brent Crane (a pro-life Republican) who chairs the Idaho House State Affairs Committee, as well as pro-life groups Idaho Chooses Life and Right to Life of Idaho.
