Status of Abortion:

LEGAL

Montana statute § 50-20-109 allows abortion up until viability at which point abortion is prohibited. The Montana State Supreme Court invented a right to murder preborn children in a 2021 ruling which decreed that the right to “procreative autonomy” was protected within the state’s privacy protections. That decision invalidated a 20-week ban passed by the State government.

Abolition History:

No bill has been introduced to abolish abortion in Montana.
