In 2021, Arkansas passed Act 309 which provided a penalty of up to 10 years imprisonment and a $100,000 fine for abortionists who perform or attempt to perform an abortion. The law gives immunity to mothers who perform their own abortions: “This section does not…authorize the charging or conviction of a woman with any criminal offense in the death of her own unborn child.”

Abolition History:

In 2023, State Senator Matt McKee and State Rep. Richard Womack filed the first real abolition bill in Arkansas. It would make preborn children equal under Arkansas State law and removes the immunity for mothers in the killing of their own children. It has been assigned to the Arkansas House Judiciary Committee.
