South Dakota

Status of Abortion:

Legal

for mothers.

Illegal

for abortionists.

Upon the overturn of Roe, South Dakota’s trigger law went into effect, banning abortion for abortionists but protecting self-managed abortion. The law specifies that only the person who “administers to any pregnant female or who prescribes or procures for any pregnant female” an abortion can be prosecuted. This means that the mother faces no legal penalty for performing her own abortion in South Dakota.

Abolition History:

No bill has been introduced to abolish abortion in South Dakota.
