Wisconsin’s pre-Roe abortion ban (Wis. Stat. § 940.04) is currently in effect, making abortion illegal for abortionists from conception. Depending on the age of the preborn child, abortion could be a Class E or Class H felony for abortionists. Mothers are exempted from any penalty. This means that Wisconsin women can order abortion pills online without any possibility of legal penalty. Wisconsin Governor Tony Evers and Attorney General Josh Kaul have challenged the law in court, but it is currently in effect.
