The Human Life Protection Act (Ala. Code § 26-23H) permits mothers to perform their own abortions while making abortion a Class A felony for anyone else who performs an abortion.


In a January 10 article at AL.com, Alabama Attorney General Steve Marshall said that while he couldn’t prosecute for homicide because of the Human Life Protection Act, he intended to prosecute women who self-manage their own abortions under a child chemical endangerment law: “The Human Life Protection Act targets abortion providers, exempting women ‘upon whom an abortion is performed or attempted to be performed’ from liability under the law,” Marshall said in an emailed statement. ‘It does not provide an across-the-board exemption from all criminal laws, including the chemical-endangerment law—which the Alabama Supreme Court has affirmed and reaffirmed protects unborn children.’”


Students for Life and their President Kristan Hawkins came out against him in a press release: “In response to the Alabama Attorney General Steve Marshall saying that women could be prosecuted for use of Chemical Abortion Pills, Students for Life Action (SFLAction) and Students for Life of America (SFLA) President Kristan Hawkins stated: ‘We need to keep our focus focusing on the predators and the abortion cartel and not the victims, as a mother and her preborn child are the targets of an industry selling death by abortion.’” Marshall backed down.

HISTORY

State Rep. David Eastman and former State Rep. Chris Kurka have introduced legislation that would abolish abortion in the state every session since 2017. Eastman has also filed legislation over the years to impeach Alaska judges for "Malfeasance includes exercising legislative power.”

Eastman and Kurka’s bills have faced opposition from Democrats as well as pro-life leaders. The pro-life group Alaska Family Action has publicly opposed Eastman’s efforts, and even worked to unseat Eastman in the 2020 election.

Upon the overturn of Roe v. Wade, it was widely thought that the pre-Roe abortion ban would go back into effect. However, the most recent Arizona appeals court ruling said that the pre- Roe ban could not go into effect because all of the pro-life regulations passed since the pre- Roe abortion ban rendered the older law void. This ruling is a based on the legal principle that when two laws conflict, the more recent law takes prominence. So it’s pro-life regulations that provided the pro-abortion judges the cover they needed to keep abortion legal in Arizona.


The result of the ruling is that the abortion ban is struck down, while all of the pro-life regulations passed since the abortion ban were allowed to stand. These include a 15-week ban, 24-hour waiting period, an ultrasound law, a Down Syndrome abortion ban, and a few others. None of these laws have any substantial impact on the abortion rate.

In 2022, Florida passed into law a bill banning abortion at 15 weeks. When abortion is legal at any stage, more than 90 percent of abortions occur before 15 weeks. Further, a 15-week ban would simply cause those who were waiting to get it done more quickly. The Florida 15-week ban has virtually no impact on abortion. Governor Ron DeSantis, a Republican Presidential frontrunner, has publicly signaled his desire to sign a heartbeat bill in the 2023 legislative session.

In 2022, after the Dobbs decision, Indiana Governor Eric Holcomb called a special session to address abortion. State Senator Sue Glick (R) authored SB1, which was passed into law. It provides mothers immunity in the murder of their own children, meaning that self-managed abortion is legal in the state. The law prohibits physicians from performing abortions in most cases, with exceptions such as rape, incest, lethal fetal abnormality diagnosis, and risks to the mother’s life or health.

In 2019, the Kansas Supreme Court ruled that the State’s Bill of Rights protects the right to abortion. The decision reads:

"All men are possessed of equal and inalienable natural rights, among which are life, liberty, and the pursuit of happiness…We are now asked: 'Is this declaration of rights more than an idealized aspiration? And, if so, do the substantive rights include a woman's right to make decisions about her body, including the decision whether to continue her pregnancy? We answer these questions, ‘Yes.’"

In truth, there is no tie between anything in the Kansas Constitution and a right to abortion. The court didn’t even connect a specific line of the Constitution to abortion. It simply said that substantive rights generally have to include murder.

Upon the overturn of Roe, Mississippi's trigger ban from 2007 went into effect. The bill specifies that abortionists may only perform an abortion in the case of rape. Violation of this law carries a penalty of 1-to-10 years in prison. The law specifies that the mother may never be prosecuted in the murder of her child: “Any person, except the pregnant woman” is liable to face prosecution. This means that self-managed abortion is legal in Mississippi.

Upon the overturn of Roe, two statutes prohibiting abortion for abortionists began to be enforced. The more stringent of the two, Okla. Stat. 63 § 1-731.4, provides penalties for abortionists of up to 10 years in prison and $100,000 fine. The law states that it “does not authorize the charging or conviction of a woman with any criminal offense in the death of her own unborn child.”


Self-managed abortion is technically illegal in Oklahoma according to Okla. Stat. 63 § 1-733. However, attorney general Gentner Drummond has shown no willingness to enforce the

prohibition and a recent study published in the Journal of the American Medical Association found that self-managed abortion tripled in Oklahoma following the overturn of Roe.

HISTORY

Former State Senator Joseph Silk filed the first bill to abolish abortion in Oklahoma in 2016. Silk filed subsequent abolition bills until he left the Senate in 2020. State Senator Warren Hamilton was elected in 2020, and picked up where Silk left off, filing the bill to abolish abortion in Oklahoma every year since.


The primary opposition to the abolition bill has come from National Right to Life Vice President Tony Lauinger, Senate Pro Tem Greg Treat (R), former State Senator Jason Smalley, and Senate Floor Leader Greg McCortney (R).

State Rep. Tony Tinderholt introduced the first bill to abolish abortion in Texas in 2017. Texas House State Affairs Committee Chair Byron Cook refused to give the bill a hearing.

Tinderholt also introduced the bill in 2019. Texas House Judiciary & Civil Jurisprudence Committee Chair Jeff Leach refused to give the bill a vote. In 2021, State Rep. Bryan Slaton became the primary author of the bill. Texas House Public Health Committee Chair Stephanie Klick refused to give the bill a hearing. Slaton has filed the bill again in 2023.


In addition to Cook, Leach, and Klick, pro-life organizations Texas Alliance for Life and Texas Right to Life have vociferously opposed the bill.

In 2022, abolitionists lobbied several Republican state senators and state delegates to sponsor the Abolition of Abortion in Virginia Act. While several legislators--including conservative-favorite Senator Amanda Chase--were sent copies of the draft to read, no legislator sponsored any bill to abolish abortion.

During the 2023 General Assembly session, Governor Youngkin's 15-week pain-capable bill and the "Hackworth Bill" (a "Life at Conception Act" that had a life-of-the-mother exception and gave mothers immunity to perform self-managed abortions) were sponsored in the General Assembly by pro-life Republicans. Republican State Senator Siobhan Dunnavant, a practicing OB-GYN, tried to amend the 15-week bill to allow for abortions up to 24-weeks if the baby had "severe fetal abnormalities." All of these efforts failed to pass in the State Senate.

With 2023 being an election year for all 140 state legislators, thus far no incumbent legislator has expressed support for an abolition bill for the 2024 General Assembly session.

Wisconsin’s pre-Roe abortion ban (Wis. Stat. § 940.04) is currently in effect, making abortion illegal for abortionists from conception. This means that Wisconsin women can order abortion pills online without any possibility of legal penalty. Wisconsin Governor Tony Evers and Attorney General Josh Kaul have challenged the law in court, but it currently is in effect.
